Impeachment Petition Aimed At Glenwood Acres Board President
A resident of Glenwood Acres is circulating the petition, aimed at removing Jason Lundy, president of the landowner's association board.
The simmering feud between the board of the Glenwood Acres Landowner's Association and Russell McFadin, a resident of the development since 1995, has bubbled over into an effort to unseat board president Jason Lundy.
In a 3 page letter he delivered to the board Monday, McFadin asks for the immediate resignation of Lundy.
In the letter, as well as in an interview with the Advocate, McFadin alleges harassment of himself by the board, unequal and unfair application of rules and restrictions, and says that the board has not followed it's own protocols and procedures. Lundy is accuses of recklessness and poor leadership.
The dispute stems from what McFadin says are efforts to single him out, and force him out of the community.
In November, McFadin, along with several other residents, received notices from the association threatening court action unless efforts were made to clean up their lots. Part of that demand by the board might have involved a structure that McFadin built on his lot, that might not comply with deed restrictions.
McFadin says he has been working on complying with the clean up demand, hauling off scrap from his lot over the last month.
He also has run afoul of the board in the past because of delinquent association dues. In September, the board filed a lien with Upshur county to force payment of those.
That issue, however, has been resolved. McFadin produced a lien release and other documents proving he had negotiated a settlement with the board, and was current on his dues.
That could be important to his impeachment effort, since a resident of the development is required to be current on their dues in order to vote on association business.
Yesterday, Mcfadin set up camp at the entrance to the development, asking residents to sign the petition.
According to bylaws of the association shown to the Advocate, McFadin needs one fifth of the estimated 1000 members of the association to sign the petition in order to force an impeachment vote.
When contacted late Friday, Mr. Lundy, through his secretary, declined immediate comment, saying the board's attorney would contact us with a statement.

Tis the question was anyone other than me surprised at the meeting
last night of the opening of it.i surely was not.pleadge was said
lundy said this is a board meeting at it goes by the agenda and they
read the minutes silently then ask for motion was seconded.
Then the treasures report was said to be printed in january newsletter so it
was not read.then the treasurer spoke i believe and the secratary
spoke of the holiday stuff and then lundy adjourned meeting while i
rose and ask mr vice president.i said mr vp i ask you relieve the
president of his duties as he will not act.i said he will not act on
the petition that has been circulating.mr vp i ask that you relieve
the chair as he will not act.lundy said the meeting was adjourned and
told me i was out of order and to sit down.then mrs moore said i was
out of order she is treasurer.but when i asked the first time for the
vp to relieve president of his duties for failure to act i had a
second by Ron Cook.
Mrs floyd,AC floyds wife spoke while this was
happening that the board was wrong they didn't read the minutes out
loud and the treasures report.lundy stated that they didnt have to.
Now i would have to assume that some of that free and legal advisement probable was used
here for lundy's actions was of such nature.I was told i had to leave the
property by the reserve constable and that Mr.Webb did so in a very
professional capacity in his job authority as per what he was there
to do.
I personally want to thank you constable webb for protecting
everyone that was there as for this meeting.I do feel that law
enforcment was a correct avenue so in the future i will be calling
personally and asking for an officer to protect the common citizens
of Glenwood Acres Subdivision.
As alot of folks in and out the county know i did not feel this way.As I
was so very opposed to having outside law enforcement there as our
bylaws and cc&r's says the association will provide security for the
protection for the common good of the people.
I say now that your cc&r's and bylaws are lewdicrious as you lundy and pugh moore and
(paul gill) showed your true identity.
Now cindy gill demanded that everyone leave the
building and had webb tell everyone they had to go after and during
the secratary of the board agreed to accept the petition.
I had been circulating along with several others that signed all total when
handed in there was 15 pages and a total of 61 signatures on 59 will
be recognized as my wife and i signed twice.one set of our names will
be struck.
I will be going to clubhouse today to ask to see the list
of good standing members.as well it is open record information i
encourage every one to go and ask to see.it is suppose to be
avaliable during all normal business hours and at every meeting
avaliable for all to see.
Mr board attorny said in news press release
speaking for the board that they were haven hard time doing that
because of marriages and divorces.hmmmm i say you are violating the
state statutes and as in such violation i will be preceding to have
state charter revoked.
As lundy at your leadership are now and mostlikely a defuncted
and failed business.
I do want to say a word of
thanks to you lundy you showed your true colors and who excactly is
backing your every play.
They are as follows; pugh,moore,gill and
of course the other gill.
Now i will list these names and positions as
follows; president--jason lundy, vice president---larry pugh,
treasurer---linda moore, paul gill sargeant at arms,and the office(what she calls
herself in public address for her job title) manager(we know as secratary)the paid
office employee.
I do not believe that sipes
or floyd had any part of your open and desisive plan to fly thru
meeting and try and adjorn before i was given opurtunity to speak.
I say lundy you have no diplomacy skills and have no understanding of a
democracy.all you understand is to be a tarrant to the people.
lundy i will now be more fervant than ever before and your are cuasing more
and more people to join the common citizens movement for you to leave
office and your placement on the board.
let me do say that i should have never had to have a movement of a impeachment form if
the whole board would do there job.the board would impeach/relieve lundy of his
duties.
It is your job as our leaders to uphold the will of the people
and most importantly the laws.everyone wants to know if an audit is

sense to leave the citizens alone that you took oath to uphold there rights or
does that mean nothing to you sir.
Or do you desire to be on the same level as a tyrant dictator of the gala board
president.
As i have copies of Cease and Deciest letters from attornies to others stating
that because they are speaking out against said board/boards they can
be held liable for other members not paying there dues and could be
held liable for Tarnishing the REPUTATION OF GLENWOOD ACRES LANDOWERS
ASSOCIATION.I am very curious to see what ya'll will be cooking up to
send to me.
Do let me advise you lundy and this one is of free and as
god is my witness if you so send me one you best send one out to all
1066 or 1067 landowners that the appaisal records show.
Now the latest plat i have recieved shows 1225 lots and reserved lands all the way to
fm 726 on both sides of glenwood drive and also the lands that were
reserved for Gilmer ISD if they ever wanted to build a elemantary
school out here.
I wonder how many know those facts and how those lands
were pulled out of the glenwood acres subdivision as well as by
whom.
Rest assured i will find the answers in the couny clerks records
and or the appaisal district.
Now mr snider i sure missed you at that
very important meeting last night as well as you mr don lesmen.lesmen
sorry about the mispelling of your name in some other articles i
wrote about you sir as i found your last name to be in court
documents from 1989 when the clubhouse burned.
Mr Snider sir i do wanna say i wish you and your attornies the very bests of luck in the
coming months and your estate as well.

Sir, you called me personally and told me that your paper would not be doing any more
reporting until others come forward.
Well sir, I turned in 59 signatures on Tuesday January 13 in about a 6-7 minute board
meeting
which was done in an illegal fashion in order to suppress the peoples voice and
their rights as well as the rights of one board member in particular.
Now, we have a numerous amount of folks say they won’t sign because they are afraid of
retribution.
So know I say sir what does your news reporting agency that ya'll sell papers thru and
advertisements and collect money for services and are you and or ya'll not honor and
duty bound to report the news for all the people?
Not just a one sided story.
I say how say you sir?

Sir I must say one last thing in closing:
You and your paper are not the only source to have done a very poor job of telling all
when your reporter and as your stance only wants to do a one sided story and not get out
here and beat the path down and do your job.
You yourself told me you were not going to be in the middle of a pissing match (your
words not mine) between Jason Lundy and myself.
CBS 19 on 8-8-2008 did a worse job than ya'll did I called the station as it was airing
when they was showing the personal information on video for the whole world to see
and telling what they owed and who they were shame on them all both
parties.
That means CBS 19 Wilton Johnson and the President of
Glenwood Acres Landowners Association Jason Lundy as well as the
office paid employee of the association for violating my rights as
well as the rights o others causing great embarrassment and undo representation of their
stability in their community which is not in Upshur County.
Long and short under this regime known as the board in said subdivision is mandatory
membership.
The current board meeting January 13th was of a kangaroo meeting at the helm of Lundy
as president.
I called for the vice president to relieve the president
of his duties as he failed to act and do his job.
I am considering asking for and calling for the immediate resignation and or
impeachment of 4 of the board members and as well for the termination
of the office paid employee of the Assn. members being as
follows; Jason Lundy -- president, Larry Pugh---vice president, Linda
Moore----treasurer, and Paul Gill--sergeant at arms.
That’s the 4.Now the paid office employee Cindy Gill as she was in derelict of her
position on numerous occasions but at the meeting she had the
constable remove everyone but Lundy Pugh Moore and Paul Gill all
citizens and 2 other board members were told they had to leave the
building and some was seen to the doorway by the constable.
What I have been told Monday night and Tuesday and Wednesday.
Do let me say again the constable Jeff Webb was of very appropriate authority in the
handling of these matters as the office employee was telling Webb who
had to leave.
She (Cindy Gill) was seen and I have audio recorded telling and I must assume the
obvious it was Lundy that I am trying I am trying they won’t leave they won’t leave.
Her attitude and her authority was so far out of line that the only action is for her to
be immediately removed from said office as paid employee.
I personally feel that personal information and files and as well other pertinent things
may be
leaving said office which is secured by brinks security and as well
bars in window inside said office for privacy and security issues.
How does Pugh get on board and ADT security systems be replaced by
the company Pugh has or is a representative of?
One wonders of lots of the indiscretions.
The fiscal year ends January 31st to the very best of my extensive researching it has
been 15 years since last audit as i have confirmed that comment from last known auditor
as
that party stated it was a mess way back then.
Is our information going to be disappearing again?
Who will help me hold these folks accountable for there and this is assumption till I or
we get the books that fraud and monies are spent inappropriately and for what and
who knows I have some very interesting facts at this time.

now does any one know specifically why the office has been closed so much since the jan 13th meeting.i went there on wensday and it had sign said closed till friday at 9 am
then i was told it was closed on friday and on monday as well.but thru the grapevine i heav heard that 2 in particle patries vehicles have been seen coming and going at so many various times and hours.one wonders what it is they could be doing
but if i had to say i would go with duplicating papers and then shredding of a large amount of others as they know i am actively persuing to have all who have committed crimes prosucuted to the fullest extent of the law with restitution and or imprisonment.if some one wants immunity they need to seek me out personally as my number is so very well published 903 841 0867 is how i can be reached.
understand that the immunity spots wont last long as i will only be excepting a few.maybe 4 at most all the rest will be standing trial.and this is not just for current board members this is for everyone one that has committed crimes of either fruad and deception.embelzelment.plain ole just out right stealing of properties for personal gains.mis use of information thru the office.
folks notorizing there own acts as one should be very careful i may go and contest these and buy them as these acts were done in unethical formats and with imorally conduct.my guess is when ya at the top ya do want ya want to and to whom.i have to wonder was it a power trip and will these folks be able to live with all there neighbors knowing what they done out here and to whom.or when this gets to be too much will you see the ole for sale sign and another place empty.
to the best of my knowledge there still has been no members in good standing list made.
what is the hold up corruption.thye dont know what to do.well if the office manager or the president will call me i will be very glad to assist them in there duties on this matter.as i have folks that are very qualified with the peachtree system that can help and know how to produce reports thru there very complex computer system.and these folks will even help show there reports and budgets and any fraudelent looking /questionable things as they pop up
